{"id":71332,"date":"2026-09-27T11:00:29","date_gmt":"2026-09-27T03:00:29","guid":{"rendered":"https:\/\/www.imoney.my\/articles\/?p=71332"},"modified":"2026-09-25T13:51:53","modified_gmt":"2026-09-25T05:51:53","slug":"us-stocks-withholding-tax-malaysia-investors","status":"publish","type":"post","link":"https:\/\/www.imoney.my\/articles\/us-stocks-withholding-tax-malaysia-investors","title":{"rendered":"US stocks from Malaysia: the 30% you may not have accounted for"},"content":{"rendered":"<h2><span class=\"ez-toc-section\" id=\"What-withholding-tax-is\"><\/span>What withholding tax is<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>When a US company pays a dividend to a foreign investor, the <a href=\"https:\/\/www.irs.gov\" target=\"_blank\" rel=\"noopener\">US Internal Revenue Service<\/a> takes a slice at source. For investors in countries with a comprehensive tax treaty with the United States, that slice is typically reduced. Malaysia does not have such a treaty with the US, so the default rate applies: <strong>30%<\/strong> of the dividend, withheld before it is paid.<\/p>\n<p>So a US share yielding 3% delivers 2.1% to a Malaysian holder. A US-domiciled dividend ETF yielding 4% delivers 2.8%. The fact sheet shows the gross figure. Your statement shows the net.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What-it-does-not-apply-to\"><\/span>What it does not apply to<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Withholding applies to <strong>dividends<\/strong>, not to <strong>capital gains<\/strong>. If you buy a US share at 100 and sell at 130, the US does not tax the 30 for a non-resident investor. And on the Malaysian side, individuals are not within the capital gains tax that applies to companies on foreign assets, and <a href=\"https:\/\/www.hasil.gov.my\/wp-content\/uploads\/20221229-guidelines-tax-treatment-in-relation-to-income-received-from-abroad-amendment.pdf\" target=\"_blank\" rel=\"noopener\">foreign-sourced income received in Malaysia<\/a> by a resident individual is exempt until 31 December 2036 under an order gazetted in December 2024, provided the income was subject to tax in the country it came from and did not arise from a partnership business in Malaysia. A US dividend that has already suffered 30% withholding meets that condition.<\/p>\n<p>The practical result: a growth-oriented US holding that pays little or no dividend loses almost nothing to withholding. A high-dividend US holding loses nearly a third of its income. The same &#8220;US exposure&#8221; behaves very differently depending on how the return arrives.<\/p>\n<p>Look into our list of <a href=\"https:\/\/www.imoney.my\/unit-trust-investments\" target=\"_blank\" rel=\"noopener\">unit trust investments in Malaysia<\/a> and select which one fits your need.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What-the-broker-does-and-does-not-do\"><\/span>What the broker does and does not do<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Your broker will ask you to complete a <strong>Form W-8BEN<\/strong>, which certifies that you are not a US person. Do it; it is mandatory and valid for about three years. But understand what it does. Most Malaysian blogs get this wrong: the W-8BEN does not reduce the 30% to 15%. That reduction exists only for residents of treaty countries, and Malaysia is not one. For a Malaysian the form confirms the 30%; there is no treaty rate to claim.<\/p>\n<p>The broker also does not reclaim anything on your behalf, because there is nothing to reclaim. The 30% is final.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Where-the-structure-changes-the-maths\"><\/span>Where the structure changes the maths<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Here is the part most guides skip. The withholding is applied by the US on dividends paid <em>out of the US<\/em>. Where a fund is domiciled decides who pays it.<\/p>\n<p><strong>A US-domiciled ETF<\/strong> holding US shares receives dividends gross, then pays them out to you with 30% withheld at the fund-to-you stage.<\/p>\n<p><strong>An Ireland-domiciled UCITS ETF<\/strong> holding the same US shares pays a <em>reduced<\/em> withholding at the US-to-fund stage, 15% under the US\u2013Ireland treaty, and then distributes to you with no further Irish withholding for a non-resident. Your effective leakage roughly halves.<\/p>\n<p><strong>An accumulating UCITS ETF<\/strong> goes one step further: it does not distribute at all. Dividends are reinvested inside the fund after the 15% fund-level withholding, and your return arrives entirely as capital gain, which for a Malaysian individual is not taxed at either end.<\/p>\n<p>Same underlying shares. Three structures. Effective dividend tax leakage of roughly 30%, 15% and 15%-with-no-distribution.<\/p>\n<p>How much this matters depends entirely on how much of the return arrives as dividend. For a broad S&amp;P 500 exposure, where US companies increasingly return cash through buybacks rather than dividends, the domicile gap is smaller than the headline suggests: an EY comparison of Vanguard&#8217;s US-domiciled and Irish-domiciled S&amp;P 500 funds over 2013 to 2024 found cumulative returns of 180.7% against 183.9%, a difference of about US$82 on a US$1,000 start once dividends were reinvested. For a high-dividend strategy, the gap is large. Match the concern to the strategy.<\/p>\n<p>View the list of available <a href=\"https:\/\/www.imoney.my\/online-investment\" target=\"_blank\" rel=\"noopener\">investment products online<\/a> and compare them conveniently.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The-cost-most-guides-leave-out-entirely\"><\/span>The cost most guides leave out entirely<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>There is a second US tax that has nothing to do with dividends, and EY&#8217;s view is that it matters more. US-situs assets, which include US shares and US-domiciled ETFs, sit inside the US estate tax for non-residents, with an exemption of only US$60,000 and rates that can reach 40% above it. A Malaysian investor who dies holding US$400,000 of US-domiciled funds leaves an estate that owes US tax before anything is distributed. Irish-domiciled UCITS ETFs are not US-situs assets and sit outside it, and Ireland does not levy estate or gift tax on non-resident holders.<sup class=\"ref\"><a id=\"cite-5\" href=\"#ref-5\">5<\/a><\/sup> For a long-term holder, this is the stronger reason to care about domicile.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What-this-does-not-mean\"><\/span>What this does not mean<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>It does not mean US shares are a bad idea for Malaysians. It means the <em>route<\/em> matters, and that a high-dividend strategy is structurally disadvantaged from here in a way a growth or accumulating strategy is not.<\/p>\n<p>It does not mean Irish-domiciled ETFs are always better.
