I tied the knot around two months ago. As part of the wedding planning we engaged with multiple vendors. One of which failed to deliver on services we paid for in advance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Negotiations eventually broke down, and I decided that it was time to take legal action. In this situation most people would immediately drag the other party to Small Claims Court. However, after some discussion with my new wife, we decided to attempt a claim through the Consumer Claims Tribunal (CCT) instead.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What-is-the-Consumer-Claims-Tribunal\"><\/span><b>What is the Consumer Claims Tribunal?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Before we get into our experience with filing a claim, first let\u2019s explain what exactly is the Consumer Claims Tribunal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Consumer Claims Tribunal, or as it\u2019s perhaps more commonly called the <\/span><i><span style=\"font-weight: 400;\">Tribunal Tuntutan Pengguna Malaysia (TTPM)<\/span><\/i><span style=\"font-weight: 400;\">, is a tribunal that allows consumers to file claims regarding any goods and services purchased against the sellers or service providers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The CCT was first established all the way <\/span><a href=\"https:\/\/www.kpdn.gov.my\/en\/corporate-info\/department\/tribunal-for-consumer-claims\"><span style=\"font-weight: 400;\">back in 1999<\/span><\/a><span style=\"font-weight: 400;\">, and it\u2019s objective is to;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">provide an alternative forum to civil courts for consumers to claim redress in respect of any goods and services purchased in a convenience, fast manner and at a minimal cost.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">hear and determine claims in an independent and just manner.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">develop the law on consumer protection.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">So simply speaking, the CCT provides consumers with an alternative way to seek compensation over any dispute they might have regarding any goods or services they purchased.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means that if you have purchased any goods or services that you\u2019re not happy with, you can file a claim under CCT to get proper redress.<\/span><\/p>\n<h3><b>Jurisdiction of the Consumer Claims Tribunal<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">However, there is one thing that you should know. Not all goods and services purchases can be filed under a CCT claim.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The CCT only has the jurisdiction to;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A claim for redress for the purchase of goods or services permitted under the jurisdiction of the Tribunal as provided under <\/span><a href=\"https:\/\/ttpm.kpdn.gov.my\/files\/consumers_act.pdf\"><span style=\"font-weight: 400;\">Act 599<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A claim where the total amount does not exceed RM50,000.00; and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A claim which accrues within three years from the incident.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"How-to-file-a-Consumer-Claims-Tribunal-claim\"><\/span><b>How to file a Consumer Claims Tribunal claim<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are a two ways on how you can file a CCT Claim, and those are;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Filling of claim at any Tribunals\u2019 counter throughout Malaysia including Federal Territories of Putrajaya, Kuala Lumpur and Labuan, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Online filling of claim via <\/span><a href=\"https:\/\/ttpm.kpdn.gov.my\/login\"><span style=\"font-weight: 400;\">https:\/\/ttpm.kpdn.gov.my\/login<\/span><\/a><\/li>\n<\/ul>\n<h3><b>How to file an online Consumer Claims Tribunal claim<\/b><\/h3>\n<h4><b>Step 1: Login page<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">First step is simple, all you have to do is click on the link given above. To submit a claim, you first have to understand the two different options given to you, which are;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Inquiries &#8211; asking the Tribunal if your case can be heard. You will need to submit details such as transaction date, brand, how much you paid, and etc.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this page, you will also be asked to submit the particulars of your claim, which means the claim statement. Here, you should explain the reason for your claim, and the company\u2019s response towards you when you asked them to reimburse you. One important thing to note is that the particulars of your claim needs to be at least 100 words, so write as much as you want.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You will then be asked to select a CCT branch where you want the hearing to take place. Now your claim is complete, and all you have to do is wait till CCT to contact you for further action.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Why-make-a-claim-through-the-Consumer-Claims-Tribunal\"><\/span><strong>Why make a claim through the Consumer Claims Tribunal?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">So what happened to my claim? Well, truthfully, it didn\u2019t go through, for good reason.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Just the mere mention of the CCT was enough for me to get my refund from the vendor. Which is a great reason to always keep this option at the back of your mind if you need it. The threat of legal action is usually enough to make most vendors think twice about putting up resistance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, there are good reasons for using a tribunal over Small Claims Court:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The process of the tribunal takes less time compared to the Small Claims Court. The tribunal does not require you to engage the services of a lawyer. This makes the tribunal more suited for small claims, as it will lower the cost of the entire process.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Always remember, part of your responsibility as a consumer is to always stay knowledgeable.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Have you heard of the Consumer Claims Tribunal before?
