For Malaysians, this has become more of a reality; with the younger generation now understanding how financial systems can make their money work for them.<\/p>\n<p>There has been a <a href=\"https:\/\/www.bursamalaysia.com\/about_bursa\/media_centre\/bursa-anywhere-release-new-features-to-allow-remote-cds-account-openings-and-e-dividend-subscriptions\" target=\"_blank\" rel=\"noopener noreferrer\">30% increase<\/a> in new local stock trading accounts opening in May this year compared to the same period last year. Retail investors activity during the period also showed a 607% increase year on year.<\/p>\n<p>The growing interest in investment among Malaysians is great news but it comes with greater risks of scams too. A recent <a href=\"https:\/\/www.nst.com.my\/news\/nation\/2019\/12\/547741\/malaysia-top-20-nations-most-affected-scam-calls\" target=\"_blank\" rel=\"noopener noreferrer\">survey<\/a> had also placed Malaysia among the top 20 nations affected by scam calls. In the first half of 2020, the Securities Commission Malaysia (SC) had already issued several warnings on an increase in <a href=\"https:\/\/www.sc.com.my\/resources\/media-releases-and-announcements\/sc-clone-firm-scams-on-the-rise\" target=\"_blank\" rel=\"noopener noreferrer\">clone firms<\/a> and <a href=\"https:\/\/www.sc.com.my\/resources\/media-releases-and-announcements\/sc-advises-investors-to-be-on-alert-for-covid-19-investment-scams-and-unauthorised-digital-asset-exchanges\" target=\"_blank\" rel=\"noopener noreferrer\">unlicensed investment schemes<\/a>.<\/p>\n<p>This year, the SC\u2019s InvestSmart\u00ae Fest is paying special attention to increasing awareness among investors so they can avoid falling prey to these scams and illegal investment schemes.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-45402 size-large\" src=\"https:\/\/static.imoney.my\/articles\/wp-content\/uploads\/2020\/10\/14141306\/InvestSmart-Cover-01-800x351.jpg\" alt=\"\" width=\"800\" height=\"351\" srcset=\"https:\/\/static.imoney.my\/articles\/wp-content\/uploads\/2020\/10\/14141306\/InvestSmart-Cover-01-800x351.jpg 800w, https:\/\/static.imoney.my\/articles\/wp-content\/uploads\/2020\/10\/14141306\/InvestSmart-Cover-01-300x132.jpg 300w, https:\/\/static.imoney.my\/articles\/wp-content\/uploads\/2020\/10\/14141306\/InvestSmart-Cover-01-768x337.jpg 768w, https:\/\/static.imoney.my\/articles\/wp-content\/uploads\/2020\/10\/14141306\/InvestSmart-Cover-01.jpg 1920w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/p>\n<p>We have all come across these self-styled \u2018<a href=\"https:\/\/www.theedgemarkets.com\/article\/even-if-youre-investment-guru-you-can-be-jailed-10-years-without-licence\" target=\"_blank\" rel=\"noopener noreferrer\">investment gurus<\/a>\u2019 on the internet who get their victims to send money in exchange for advice and investment tips without properly checking first. So, it\u2019s important to know who you can ask and to learn how you can avoid falling prey to scams.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who-is-allowed-to-give-investment-advice\"><\/span>Who is allowed to give investment advice?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>By law, not everyone is allowed to give investment advice. In Malaysia, it\u2019s a highly regulated profession under the <a href=\"https:\/\/www.sc.com.my\/regulation\/acts\/capital-markets-and-services-act-2007\" target=\"_blank\" rel=\"noopener noreferrer\">Capital Markets and Services Act 2007<\/a> (CMSA). Basically, those that want to give investment advice (that is providing reports, advice or analysis on securities) must first be registered and licensed with the SC.<\/p>\n<p>Whether your advisor provides formal analyst reports or shares investment tips on Facebook, all forms of investment advice are covered under Malaysian law outlined in the CMSA and are overseen by the SC.<\/p>\n<p>All the following types of financial advice require a license:<\/p>\n<ul>\n<li>Dealing in securities<\/li>\n<li>Dealing in derivatives<\/li>\n<li>Fund management<\/li>\n<li>Dealing in Private Retirement Scheme<\/li>\n<li>Advising on corporate finance<\/li>\n<li>Investment advice<\/li>\n<li>Financial planning<\/li>\n<\/ul>\n<p>Source: <a href=\"https:\/\/www.sc.com.my\/regulation\/licensing\" target=\"_blank\" rel=\"noopener noreferrer\">Securities Commission Malaysia<\/a><\/p>\n<p>Avoiding the jargon, this simply means that you need a license if you want to make money by telling people about how markets are performing and what to invest in.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Check-if-your-investment-advisor-has-a-license\"><\/span>Check if your investment advisor has a license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Unlicensed investment advisors potentially face up to 10 years in prison, a fine of up to RM10 million, or both. To help the public, the SC has publicly listed the names and information of <a href=\"https:\/\/www.sc.com.my\/regulation\/enforcement\/investor-alerts\/sc-investor-alerts\/investor-alert-list\" target=\"_blank\" rel=\"noopener noreferrer\">unlicensed investment advisors<\/a> in Malaysia.<\/p>\n<p>Just this one simple step to do a background check can save you the heartache of losing your money to scammers. Most types of investment schemes in Malaysia need a license or proper registration with a government body.<\/p>\n<p>Keep in mind the following before making an investment:<\/p>\n<ul>\n<li>Check if your investment advisors or companies are licensed or registered<\/li>\n<li>Ask for information\/documents and check with SC, BNM, Ministry of Domestic Trade and Consumer Affairs, CyberSecurity Malaysia or Companies Commission of Malaysia<\/li>\n<li>Don&#8217;t rush into making an investment<\/li>\n<li>Be extra careful with investment opportunities on social media platforms<\/li>\n<li>Keep your personal information safe (MyKad, bank details, home address)<\/li>\n<\/ul>\n<p>Source: <a href=\"https:\/\/www.sc.com.my\/covid-19\/scam\" target=\"_blank\" rel=\"noopener noreferrer\">Securities Commission Malaysia<\/a><\/p>\n<p>And most important to remember \u2013 don\u2019t hand over cash or transfer any monies into personal bank accounts of any individuals for investment purposes.<\/p>\n<p>If you do come across any unlicensed investment advisors, or those operating illegal investment schemes or platforms, contact the SC\u2019s Consumer and Investor Office at +603-6204 8999 or e-mail: <a href=\"mailto:aduan@seccom.com.my\" target=\"_blank\" rel=\"noopener noreferrer\">aduan@seccom.com.my<\/a>.<\/p>\n<p>The number of online scams is increasing, so investors must avoid being deceived in their search for yield in this low interest rate environment.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"How-do-you-find-a-licensed-investment-advisor\"><\/span>How do you find a licensed investment advisor?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The InvestSmart\u00ae Fest is the best place for you to get started.
